There will be a Judicial Review of the decision by the County Council to grant permission for mineral extraction at Ladybridge. For members of the public wishing to attend, the court has fixed the hearing for the rolled up JR for Thursday, 11 June, estimated at one and a half days. The hearing will be at the High Court in the Royal Courts of Justice on the Strand in London. The exact time will not be known until the day before, but hearings usually start at 10 or 10:30am.
The grounds are likely to hinge around the County Council’s failure to take account of the cumulative loss of the landscape setting of the henges and landscape character in general.
Documents indicate that Members of the Planning Committee were not afforded the opportunity of seeing evidence that the landscape had been assessed as being of good character and in good condition and that the after-use of the quarry would not be beneficial to wildlife and the landscape’s character. A plan to prevent military bird strike which was available prior to the planning meeting in August 2009 was not shown to Members. The plan involves the ‘controlling’ of flocking birds by all means, including shooting. If the plan is implemented it will result in a steep sided deep water pit lake.
Instead, Members were led to believe that the existing landscape was poor and the after-use would outweigh any detrimental effects to the landscape.
Campaigners believe that the above, added to the already significant known negative impacts would have caused the council planners to reject the application to quarry at Ladybridge Farm, site of a Neolithic settlement and claimed to be part of a wider archeological context for Yorkshires mighty Thornborough Henges.
