(2007-05-17) | The freedom and the shame of the American system. Spruce Hill is listed in the National Register of Historic Places as Site - #72001039, but it is private land. (You'll see that a great many of the Portal's United States listings are also NRHP sites.) This listing provides some federal tax incentives to preserve the property if it is a building. It also prevents the use of federal money to be used in a project that would destroy or harm the site, without levels of review. (So a new buyer would have to have special review and permission to use government grant funds to damage something on site.) Many individual states and local governments have used the listing to add their own level of protection over these sites, but there is nothing in Ohio or Ross County law that adds to the very limited federal rules.
If a private company or individual buys the Spruce Hill lots, the only laws that are likely to apply would be national and state laws on the excavation of human remains. In a likely scenario, a private developer buys the land, sells the best timber, and leaves enough trees to "decorate" building lots. If, during the building of logging roads or the development of streets, electric and water lines, human remains are found, the work would have to stop long enough to secure the bones and turn them over to proper authorities. Any other preservation or research prior to development would up to the owner - as you say - at his whim - or as others might put it - within his rights.

(2007-05-18) | Sounds like you have a great system in place, keeping up the spirit of unhindered unfettered capitalism , nothing must get in it's way ! Not that things are good in the UK; where I used to visit ploughed up (destroyed) bronze age cairns in Wales, or other sites covered with conifers....... And the same thing goes on in France, where the only sites they seem interested in preserving are in Brittany.... |
