English Heritage has issued a statement on this issue:

PHOTOGRAPHY AND STONEHENGE

English Heritage looks after Stonehenge on behalf of the nation. But we do not control the copyright of all images of Stonehenge. And we have never tried to do so. We have no problem with photographers sharing images of Stonehenge on Flickr and similar not-for-profit image websites. We encourage visitors to the monument to take their own photographs.

If a commercial photographer enters the land within our care with the intention of taking a photograph of the monument for financial gain, we ask that they pay a fee and abide by certain conditions. English Heritage is a non-profit making organisation and this fee helps preserve and protect Stonehenge for the benefit of future generations. The majority of commercial photographers respect this position and normally request permission in advance of visiting. We regret the confusion caused by a recent email sent to a picture library.

I would still make the point that commercial sites use every image as part of their business for profit and where advertising is used alongside images of any kind these images become linked to that business process.
Companies like Google and Yahoo use everyday images that may be copyright of the photographers but the owners of the subject matter are of course entitled to nothing. Why should EH or NT think they are any different?

Isn't this only to do with images that are being sold for profit?

From The Captain's link,

Even if that's so, I don't agree with it.

In my limited research in the past on this subject the impression I have is that imagery is only controllable once you have agreed to the landowners or guardians terms and conditions by entering a site. Images taken from the public domain are the intellectual property of the photographer, in the same way that the press photographs celebrities and criminals if this law was enforceable those people would have a claim on photos being published without regard for where they are taken.
After all if this was anything other than a try on we would all be claiming our cuts from Google Earth for showing our houses etc.!!

Looks like EH are now following the NT andtrying to claim copyrght over all images of sites under their stewardship, which of course includes stonehenge. Can they actually do this ?
